What is a Month-to-Month Tenancy?

A month-to-month tenancy is a rental agreement that:

  • Renews automatically each month
  • Has no set end date
  • Can be terminated by either party with proper notice
  • Termination Notice Requirements

    For month-to-month tenancies in Texas:

  • You must give at least one rental period notice (usually 30 days)
  • The notice must be in writing
  • It should specify the date the tenancy will end
  • Example Timeline

    If rent is due on the 1st of each month:

  • January 15: You give termination notice
  • February 28: Tenancy ends (one full rental period)
  • March 1: If tenant hasn't left, deliver Notice to Vacate
  • March 4+: File eviction if tenant still present
